Phase II: Diligence Execution – $295

The search doesn’t end with the investigator’s report. Courts expect a comprehensive record of all reasonable efforts, including what you personally attempted before turning to professionals.

This phase includes:

  • Collecting Your Prior Efforts
    Did you try reaching out to relatives? Send letters to a last known address? Check online records? These efforts are documented and integrated into the record.
  • Extended Attempts
    Additional diligence may include checking postal forwarding, utility accounts, voter rolls, or employer records. Even if these checks return “no information,” they must be logged for the court.
  • State-Specific Documentation
    Each jurisdiction uses slightly different terminology — Affidavit of Diligent Search, Affidavit of Due Diligence, Declaration of Diligence, or Affidavit for Citation by Publication. We prepare the affidavit in the correct format for your state.

Why it matters: Courts want proof that every reasonable stone has been turned. Diligence isn’t about finding your spouse at all costs — it’s about showing the court you tried in good faith. This phase closes any gaps that might otherwise cause your affidavit to be rejected.

Combined Package – $470

Most clients choose the combined package, which includes both the investigator’s report and the diligence affidavit. Together, these steps provide:

The Process: From Start to Finish

  1. Search & Report (Phase I)

    - Results delivered in 2–3 business days.
  2. Extended Diligence & Affidavit (Phase II)
    - Your own prior efforts are documented and combined with the investigator’s findings.
    - Additional checks are logged.
    - A sworn affidavit is drafted in your state’s required format.
  3. Notarization
    - The affidavit must be signed under oath.
    - Where permitted, this can be completed online via secure identity verification and video conference.
  4. Filing & Publication (Client’s Next Steps)
    - With the affidavit in hand, you need to have other documents required for the Divorce by Publication drafted and notarized,    file them and request service by publication in your state court.
    - Courts typically require 3–4 weeks of newspaper publication plus a waiting period (20–30 days).
    - Filing fees and publication costs are separate.

Timeline

On average, our two-phase process takes 2–3 weeks.

  • Investigator’s report: 2–3 business days.
  • Diligence documentation and affidavit: 7–9 business days after intake is complete.
  • Notarization: usually same day once the affidavit is finalized.

After that, timing depends on your local court’s schedule and statutory publication requirements.
